These Terms of Service ("Terms") apply to all services offered by Hitify, accessible at hitify.app ("Service", "we", "us", "our").

1.2

By accessing or using our Service, you ("User", "you", "your") agree to these Terms. If you do not agree, you must not use the Service.

1.3

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

2.1

Hitify provides a platform for creating personalized music cards compatible with the Hitster board game and similar games.

2.2

Users can import songs from Spotify playlists and generate printable cards with QR codes that link to music previews.

2.3

We offer both free and paid services. Free users can create packs with a limited number of songs. Paid options offer extended capabilities.

3. Use of Service

3.1

You agree to use the Service only for personal, non-commercial purposes.

3.2

It is prohibited to: (a) upload content that infringes on copyrights or other rights of third parties; (b) misuse, disrupt, or overload the Service; (c) use the Service for illegal activities; (d) provide inaccurate or misleading information.

3.3

We reserve the right to refuse or terminate access to the Service for violation of these Terms.

4. Intellectual Property

4.1

Hitify is not affiliated with, sponsored by, or endorsed by Hitster, Jumbo, or any music rights holders.

4.2

Hitster is a registered trademark of Jumbo Diset, S.L. All music, artist names, and related metadata belong to the respective rights holders.

4.3

The Hitify software, design, and branding are the property of Hitify. Unauthorized use is prohibited.

4.4

We do not claim ownership of music content. QR codes link to previews made available by Spotify.

5. Spotify Integration

5.1

Our Service uses the Spotify API to retrieve music information. This integration is subject to Spotify's Terms of Service.

5.2

You are responsible for complying with Spotify's terms when using our Service.

5.3

We are not responsible for changes to Spotify's services that may affect Hitify functionality.

6. Product Information and Data Accuracy

6.1

The information on cards (artist, title, year) is sourced from external sources, primarily Spotify. We strive for accuracy but cannot guarantee that all information is 100% correct.

6.2

All card data in a pack is fully visible and verifiable before payment. You have the opportunity to review all information before placing an order.

6.3

If you notice incorrect data, you can suggest a correction via our website or by contacting us at [email protected].

6.4

We review correction suggestions and implement them if justified. You will receive a notification when your suggested correction has been processed, so you can wait with placing your order if desired.

7. Orders and Payments

7.1

All orders at Hitify are custom products specifically generated for you based on your selection of songs and configuration.

7.2

Payments are processed through secure payment services . We do not store credit card information.

7.3

Prices include VAT unless otherwise stated. We reserve the right to change prices, but ongoing orders will not be affected.

7.4

After successful payment, you will receive access to your digital product (PDF download) or confirmation of your physical order.

8. Refund Policy

8.1

Since all orders are custom products specifically generated for you, refunds after delivery are not possible. By placing an order, you acknowledge this and waive the right of withdrawal for digital products as permitted by applicable law.

8.2

For digital products (PDF downloads): No refunds are possible after the download is made available, as the product is delivered immediately after payment and is specifically generated for you.

8.3

For physical products: No refunds are possible as each product is made to order. Exceptions are only made for demonstrable production errors on our part.

8.4

In case of technical issues that make the use of the product impossible and that are attributable to us, we will offer, at our discretion, a replacement or refund.

8.5

Errors in card data (artist, title, year) do not qualify for refunds, as all data is verifiable in advance (see section 6.2). You are encouraged to suggest corrections so we can improve our database.

9. Liability and Disclaimer

9.1

The Service is provided "as is" and "as available" without any warranty, express or implied.

9.2

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) all information is accurate or complete; (c) the Service meets your specific requirements.

9.3

To the extent permitted by law, we are not liable for: (a) indirect, incidental, or consequential damages; (b) loss of data, profits, or goodwill; (c) damages resulting from unauthorized access to your data.

9.4

Our total liability is limited to the amount you paid for the specific service to which the claim relates.

10. Privacy and Data

10.1

We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws including GDPR.

10.2

By using the Service, you consent to our data collection and processing as described in our Privacy Policy.

11. Changes to Service

11.1

We reserve the right to modify, suspend, or terminate the Service at any time, with or without prior notice.

11.2

We are not liable to you or any third party for any modification, suspension, or termination of the Service.

12. Governing Law and Disputes

12.1

These Terms are governed by the laws of the Netherlands.

12.2

Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer law dictates otherwise.
